Samsung Electronics America has filed a complaint with the U.S. Federal Maritime Commission (FMC) over issues stemming from the pandemic-era container shipping crisis. The company is seeking at least $186 million from CMA CGM.
According to Splash247, Samsung Electronics America is seeking at least $186 million from CMA CGM in a complaint filed with the U.S. Federal Maritime Commission. The dispute concerns door-to-door shipments handled by the French carrier since 2020.
Samsung claims that CMA CGM did not always deliver containers from marine and rail terminals to the agreed inland destinations, despite the relevant services having been paid for in advance. As a result, the company alleges, costs related to delays, demurrage and storage were passed on to Samsung.
The complaint covers more than 120,000 payments, including more than 26,000 demurrage charges and over 94,000 delay-related charges. The total claim includes $148 million in disputed fees, at least $8.1 million in expenses for inland transportation and around $30 million in interest.
Samsung is also pursuing similar claims against other carriers, including COSCO, HMM and OOCL. Last year, an FMC administrative law judge awarded the company $3.68 million in a dispute with ZIM, although the decision has not yet become final.
CMA CGM was notified of Samsung’s complaint on September 1. The carrier has 25 days from the date of notification to submit its response. An initial decision is expected by September 2027, with a final ruling scheduled for March 2028.
